Holiday rentals in Menorca in 2026: what the law allows for a new-build home

New holiday-rental activities in homes cannot currently be started in Menorca: Balearic Law 3/2022 suspends them until the island's cap on tourist beds is set. In addition, the Balearic Tourism Act requires the home to be at least five years old, unless a regulation sets a different period, so a newly built villa could not start before then.

The suspension in Menorca

“1. The start of new tourist activities is suspended on the island of Menorca for hotel accommodation, tourist apartments, rural tourism accommodation, hostels, refuges and inns, as well as residential homes marketed to tourists or holiday tourist homes, and also the increase in places at establishments currently operating.”Ley 3/2022, second additional provision, paragraph 1

The suspension lasts until the island's tourist carrying capacity is assessed through the tourism intervention plan (PIAT) or the island territorial plan (PTI), or until the plenary of the Island Council (Consell Insular) definitively approves the cap on tourist beds based on a carrying-capacity study (paragraph 3, as worded by Decreto-ley 4/2025).

As of 19 November 2025, the local press reported that the Consell was finalising that cap. Before counting on a holiday rental, check with the Consell Insular de Menorca whether the suspension is still in force.

Paragraph 4 sets out exceptions for situations that predate the law (works in progress, permits applied for or granted in the previous six months, territorial redevelopment areas and some rural tourism procedures). None of them applies to a new home that someone now wants to use as a holiday rental.

Five years old

Even once the suspension is lifted, the Tourism Act imposes a requirement that directly affects new homes:

“17. Residential homes for which the declaration of start of activity for marketing tourist stays is submitted must have the minimum age determined by regulation, which may be proven by the declaration of new construction or the first-occupancy licence, or by a municipal certificate issued for this purpose. During this period, the home must have been used as a private residence. In the absence of a regulation, the minimum age shall be five years.”Ley 8/2012 (Balearic Tourism Act), art. 50.17

Other requirements of the Tourism Act

  • Suitable zone: new declarations can only be submitted for homes located in zones expressly declared suitable (art. 50.3).
  • Short stays: tourist letting means renting out the entire home by the day or the week, with no stay longer than a month, that is, thirty nights (art. 50.13).
  • Protected rural land: new activities are not allowed in homes located on it, except as reasoned in the PIAT or PTI (art. 50.18).
  • Energy and utilities: a minimum energy certificate (rating D for buildings after 2008, in the absence of a regulation) and individual meters (art. 50.5 and 50.6).

What this means if you buy a LLUM villa

The LLUM villas are new homes designed for their owners' own use. Under the rules in force on the date of this article, they cannot be used as holiday rentals: the Menorca suspension prevents it today and, in addition, the law requires the home to be five years old in the absence of a regulation. If holiday letting matters to your decision, ask about it before buying.
